Definitions

  • Accommodation or Properties – The Old Farmhouse or The Maid’s Cottage
  • Booking conformation – the act of confirming a reservation for a property at Roughs Farm Retreats by writing, usually in the form of an email
  • Booking price – Price agreed on reservation of the property
  • Email – [email protected]
  • Guest or Guests – Customers renting the properties on a short-term basis from Roughs Farm Retreats. The Guest is the lead guest responsible for the booking.
  • Rental Period – The arrival date from 4pm on the day of check in until 10am on the day of departure. It is agreed on the day of booking.
  • Rental Fee – The fee paid for the rental period
  • ‘Roughs Farm Retreats,’ ‘us,’ ‘our’ or ‘we’ – The partners of T E Darby & Sons

General

The terms and conditions of your booking for your stay with Roughs Farm Retreats is represented below. Please read them carefully and check that the details of your booking are accurate. Once you submit a booking reservation you will receive a booking conformation, these terms become binding when you receive that email.

 

Roughs Farm Retreats is a trading name of T E Darby & Sons. The partnership is a family business operating from Roughs Farm, Sawtry Fen, Huntingdon, PE28 5YZ.

 

Roughs Farm Retreats provides accommodation for guests for a minimum rental period of 3 nights and a maximum of 21 nights for the purposes of leisure and holidays.

 

Our accommodation is located on the edge of our farmyard. Please strictly observe No Entry notices, which are no entry for your safety. Keep children under close control when outside of the properties.

 

We are a working arable farm and at times (especially in the summer, over harvest) there could be noise from our drying fans, engines, and tractors late into the evenings. When booking either The Old Farmhouse or The Maid’s Cottage individually, please be aware that there may be noise from your neighbouring guests, especially in the gardens in the summer.

 

We will supply the property to you for the period set out in the booking conformation, access is granted in adherence to these terms and conditions.

 

 

Self-Catering

We provide self-catered accommodation in two properties: The Old Farmhouse and The Maid’s Cottage, which can be let individually or together as The Whole Home.

 

For your stay we provide the following:

Toilet rolls (2 per bathroom), kitchen roll, cling film, aluminium foil, a small cleaning kit (containing washing up liquid, a washing up brush, extra bin liners, j-cloth, washing up sponges, tea towels and hand towels, small quantity of dishwasher tablets and washing machine tablets), a small welcome pack (containing a small quantity of sachets of sugar, cooking oil, small provision of tea, coffee and biscuits and a small quantity of milk), salt and pepper. Bed linen including the bed sheets, duvets, blankets, pillows, a bath sheet and hand towel per person. All bathrooms have a supply of liquid hand soap and body wash.

In The Old Farmhouse a quantity of (20) logs will be provided for initial use in the wood burner, additional logs will be available to be purchased during your stay.

There is a dog wash and bike store which is shared between the two properties (a locked shed).

 

The Maid’s Cottage

Included in the price of your stay, the use of:

Central heating, smoke and fire alarms, fire extinguishers and first aid kit. Sofa (which turns into a double sofa bed suitable for children or occasional guests), armchair, table and lamp, smart TV, small table and chairs suitable for up to 4 people. Small vacuum cleaner, torch, small number of games and books, iron and ironing board. Cooker, hob, microwave, fridge with freezer box, dishwasher, washing machine, kettle, toaster, kitchen utensils, cutlery, plates, cups, cafetiere, glasses and an Amazon Alexa. Bath with over bath shower, sink, mirror, toilet. King sized bed, bedside tables, wardrobe, dressing table with draw space and mirror. Hot tub (3 person), patio table with 4 chairs and parasol, charcoal BBQ (charcoal not provided), swing seat, washing line, enclosed garden, designated parking. A portable air conditioning unit is placed in the bedroom and sun loungers in the garden in the summer months.

 

The Old Farmhouse

Included in the price of your stay, the use of:

Central heating including underfloor heating, smoke, fire, and carbon monoxide alarms, fire extinguishers and first aid kits. Washer / dryer, dish washer, fridge freezer, cooker, hob, microwave oven, hot water canister, kettle, toaster, large central island with bar stools, kitchen utensils, cutlery, plates, cups, glasses, cafetiere, small vacuum cleaner, torch, iron, and ironing board and an Amazon Alexa. Large dining room table and 10 chairs, extra table and 4 stools, games, books. Two large sofas, armchair, ottoman, smart TV. Five bedrooms with two bedspaces in each (two king beds, one double, one king/ two small singles, one super king / twin beds), wardrobes, bedside tables, dressing tables, en suite bath (bedroom 1) or showers (bedrooms 2, 3 and 4) with toilet, sink and mirror. Level access downstairs with access through the kitchen, lounge, or downstairs bedroom. Wetroom (bedroom 5 downstairs) with elevated toilet, grab rails, sink, shower and emergency alarm. Hot tub (8 person), large patio table with 10 chairs and parasol, charcoal BBQ (charcoal not provided), washing line, large enclosed garden and private parking. Fans provided in bedrooms in the summer and sun loungers in the garden.

 

Properties are advertised as providing several services, facilities, and amenities. While every effort is made to this end, the availability and proper functioning of these cannot be guaranteed. Roughs Farm Retreats is not responsible to provide any refund or alternative provision of said service, facility or amenity.

 

Vehicles may only be parked in designated areas. If a vehicle is parked on or in front of an access route to the property without authorisation, failing attempts to contact the Guest, Roughs Farm Retreats reserves the right to tow the vehicle away.

 

 

Condition of the Property

The Guest is responsible for taking all reasonable care of the property and its contents which are available for guests during their stay. The property and its contents must be left tidy at the end of the Rental Period and the check-out procedures (detailed in the house manual) followed. No items should be removed from the property. Any breakages should be reported.

 

The Guest is responsible for ensuring that no person staying or visiting the property during the Guest’s stay will do anything which would endanger T E Darby & Sons insurance policies in respect of the property and its contents which might make them void or voidable.

 

Any defects in the property should be reported to the owners in the first 24 hours of the rental period.

 

 

Keys

The loss of a key to a property or room will be charged at £150 (as locks will need to be changed). Keys must be returned upon check-out as stipulated in the properties house manual. If left in a keysafe, it is the responsibility of the Guest to ensure the keysafe is locked properly.

 

In the case of the key not being found in the keysafe or designated check-out box following check-out, or if the keysafe code has been changed or for another reason the keysafe fails to open or we are unable to retrieve the keys, this will be treated as the Guest having lost the key.

 

Duplication of keys is not permitted. Divulging access arrangements to third parties is not permitted.

 

 

Booking

All bookings can be placed through our secure website (www.roughsfarmretreats.com) which directs to our booking engine (www.roughsfarm.holidayfuture.com) which will show our up-to-date availability. Bookings, availability, and any questions can be posed through our email [email protected]

 

The guest placing the booking must be over 18 years of age on the check-in date and will need to provide their full name, email, telephone number, address, and date of birth.

 

Upon booking, the full names, dates of birth and nationality of all guests staying must be supplied to us in line with the Immigration (hotel records) Order 1972 through our booking form. For those who are not British, Irish or from the Commonwealth, guest’s passport numbers and place of issue will be recorded and details of their next destination. If the guests change, we will need to be informed prior to the commencement of the Rental Period. The maximum number of guests who can stay in each property is stated on the website. You will guarantee not to exceed that number.

 

The information given to process the booking will be held for 12 months, unless they have chosen to opt in for marketing, through the following statement by SMS/Phone, Email and Post.

 

The statement is as follows: Roughs Farm Retreats is committed to protecting and respecting your privacy, and we will only use your personal information to administer your account and to provide the products and services you requested from us. From time to time, we would like to contact you about our products and services, as well as other content that may be of interest to you. If you consent to us contacting you for this purpose, please tick below to say how you would like us to contact you:’ This is information will be held until the guest asks for it to be removed for the purposes of advertising only and only by Roughs Farm Retreats.

 

Rental Period

Rentals commence at 4pm on the day of arrival and end at 10am of the day of departure unless different check-in and check-out times have been agreed, in which the latter shall define the ‘rental period’. If available a later check-in or check-out may be arranged which may be subject to an additional fee, if agreeable by all parties. Check out times are strict as The Old Farmhouse can take 6 hours to clean, therefore a late checkout or early check in may not be possible. If in exceptional circumstances the property is not ready by the agreed check in time the guest will be informed as soon as possible.

 

The rental period dates will be stated on the reservation confirmation provided to the Guest when they book and cannot be exceeded unless Roughs Farm Retreats gives written approval. The guest will be liable for any cost, of whatever nature, incurred because of an unauthorised extension.

 

We will meet you at the property when you check in unless we are not available, if this is the case, we will introduce ourselves to you as soon as possible after your arrival. Check in information will be provided two weeks before your stay.

 

We live on the same site as the property and will be on hand if you have any questions or concerns. 

 

Prices & Fees

All prices are quoted in UK Pounds Sterling and include VAT. Prices are based on the dates selected by the guest at the time of booking and are subject to variation on the price paid depending on seasonality, occupancy, and day of the week along with other factors.

 

Unless otherwise specified, the price quoted for the accommodation include all utilities and taxes. Any extra charges are at our discretion.

 

There are services provided at accommodation which will be paid for at the beginning or end of the guests stay which includes but is not limited to: extra logs for the wood burner in The Old Farmhouse.

 

Payment

When you make your booking, if the start date of your rental period is more than 6 weeks in advance you will need to pay Roughs Farm Retreats: a deposit equal to one third of the Rental Fee at the time of booking and the remaining balance of the Rental Fee 6 weeks prior to the start of the Rental Period.

 

The payment card details are held securely by our payment processor stripe and booking engine Hostaway. Six weeks before your check in date, your card will be charged the remainder of the rental fee. If such balance if not paid in full by the date, 6 weeks in advance of the start of the Rental Period, we reserve the right to cancel your Booking and retain a percentage of the deposit, which is determined by when the cancellation is confirmed.

 

If your Booking is made 6 weeks or less before the start of the Rental Period, the entire Rental Fee will be payable at the time of your booking or bank transfer by arrangement.

 

For all bookings through our website, payment must be completed online at the time of reservation via a credit or debit card.

 

 

Cancellation

If you cancel your Booking for any reason, you must notify us in writing (by email) at the address stated in the booking confirmation.

 

A cancellation charge is payable depending on the number of days before the Rental Period start date that the notice of cancellation is received by Roughs Farm Retreats. For a full refund, you must cancel 30 days before check-in or within 48 hours of booking (only if the booking is at least 14 days before check in). Between 7 and 30 days, you will be refunded 50%, 7 days or less no refund will be applicable.

 

If following a cancellation, the selected property is re-let for the Rental Period then you will receive a full refund of the Rental Fee less any amount already received by you in accordance with above. This will be paid to you at the time the replacement booking is fully paid.

 

If we are unable to refund your whole booking, the costs that have not been incurred to us (i.e., cleaning and laundry) will be refunded to you, as will the VAT on the whole booking as no services will have been provided. This will be shown on the invoice sent to you.

 

In exceptional circumstances Roughs Farm Retreats may find it necessary to cancel the Guest’s booking and reserves the right to do so at any point. In this unlikely event we will contact you as soon as possible and endeavour to find alternative accommodation, provide a different rental date or to offer a full refund of monies paid to date. If the alternative accommodation is not acceptable to the Guest, a full refund of the monies paid will be given.

 

Roughs Farm Retreats reserves the right to terminate a booking at any time on the grounds of abuse to staff, mistreatment of the property, or criminal activity on the part of the Guests. Any sign of the house rules being broken including smoking inside the property, will result in immediate termination of the booking with no refund being offered.

 

No-shows are treated as guest cancellations on the day and no refunds will be made. Roughs Farm Retreats strongly recommends all guests obtain appropriate travel insurance to cover any charges in the event of a cancellation.

 

Security Deposit

A security deposit of £500 is required prior to arrival for The Old Farmhouse, £130 for The Maid’s Cottage and £600 for The Whole Home.

 

This will be captured as a pre-authorisation of funds from your payment card prior to arrival and will be auto-released after departure if no charge against it is made. Should a charge be made, you will be notified of the amount and the reason by email. As our payment processor Stripe does not allow pre-authorisation for longer than 7 days, if your booking is 5 nights of longer, your card will be charged the security deposit and refunded in the same timescale as above.

 

Please note that funds could take up to 14 working days to show as available again on your card, depending on your card provider’s timescales and this delay is outside our control.

The Guest must follow the instructions in the guidebook. Any losses, damage, or any cleaning necessary over and above the normal servicing, will be deducted from the Security Deposit. By placing a booking with Roughs Farm Retreats, the Guest authorises it to deduct payment for these from your Security Deposit.

 

If any damage or breakages have occurred during the Guest’s stay, the Owners should be informed as soon as possible.

 

The Guest will be responsible for making good any damage to the property or its contents, which has occurred due to negligence, wilful damage, damage by dogs or irresponsible behaviours on the part of those occupying the property or their guests. If the cost of repair or replacement is above the Security Deposit, the additional cost of the repair or replacement must be agreed with and paid to Roughs Farm Retreats.

 

All items of fittings and furniture provided to be used during the Guests stay must not be removed by the Guests. Any items found lacking will be deducted from the security deposit.

 

Accessibility

Our company operates in accordance with the Disability Discrimination Act 1995 and the Equality Act 2010 and as such, we encourage all prospective guests to talk to us about any special accommodation requirements they may have.

 

The downstairs and access to The Old Farmhouse (via the Kitchen, lounge, and downstairs bedroom) is level access with widened doorways. The wet room has a raised toilet and grab handles. There is a pull cord alarm system in the wet room to alert other guests.

 

Our aim is to make all guests stay as comfortable as possible.

 

 

Linen

All linen and towels are included and changed prior to the Guest’s stay. If the booking exceeds 7 nights, a linen and towel change will be provided free of charge on the 7th day.

 

 

Cleaning

The property will have been cleaned by a professional cleaning company prior to the Guest’s arrival. The Guest undertakes to notify Roughs Farm Retreats at their earliest convenience should they notice inadequate cleaning, so we can endeavour to rectify the situation. If the booking exceeds 7 nights, an additional clean will be provided free of charge on the 7th day.

 

The Guest is asked to remove all used bed linen, place in the bathrooms, and leave the property in a tidy condition, ensuring that all used dishes are loaded in the dishwasher and the dishwasher is turned on prior to departure.

 

 

Wi-Fi

Wi-Fi is provided free of charge at the properties for recreational legitimate purposes only. There is no guarantee that the speed will be adequate for streaming or video calling or that the internet service will be compatible with your device. Should the broadband connection not be functioning for any reason no liability is taken by Roughs Farm Retreats, and we are not held liable for any losses resulting from the loss of connection. Please inform us at your earliest convenience of malfunctioning internet.

 

Information

 

Roughs Farm Retreats reserves the right to amend prices quoted, due to errors or omissions.

 

While every endeavour is made to portray a true representation of the properties, no guarantee can be given to the accuracy of the photographs or descriptions.

 

All information supplied by Roughs Farm Retreats is given in good faith is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made either in writing or otherwise, but Roughs Farm Retreats is not liable for any variation however caused.

 

Complaints

Any complaints about the property, its contents, our service, or staff must be made immediately (at the time of the occurrence) by both channels below:

By telephone and by email.

 

We must be notified as soon as reasonably practicable, as we may be required to conduct an on-the spot investigation and take remedial action. Should you have a complaint, please allow us the opportunity to put matters right during the rental period.

 

If it is not possible to settle a dispute between a guest and ourselves, we would endeavour to use an Alternative Dispute Resolution provider.

 

 

Force majeure

Roughs Farm Retreats will not be liable for any delay, loss, damage or expense incurred if the Guest’s booking needs to be altered or cancelled or if Roughs Farm Retreats is unable to perform its contractual obligations as a result of events beyond its control which shall include but not be limited to events such as war, civil strife, terrorist activity, labour disputes, natural or man-made disaster, fire, flood, pandemic and weather conditions.

 

 

Right of access

We will need twice daily access to maintain the hot tub for your safety. Our representatives and subcontractors have the right of access to the property at any time, with due regard to the convenience of the Guest, for the purpose of inspection of the property, essential repair, or maintenance work.

 

We are not and shall not be held responsible for any maintenance / building works taking place outside of the rental property.

 

 

Security of Tenure

As the property is used as a serviced Rental Period accommodation it is exempt from security of tenure under the Rent Act. No rights of tenancy are created for the Guest(s) after the term of this agreement expires, which coincides with the published check-out time, and which is included by default in the Guest’s booking requests

 

 

Insurance

It is recommended that personal insurance be taken out against cancellation, loss of goods, personal accident, and medical insurance as appropriate.

 

 

Authority to sign

 

The person who places the booking certifies that he or she is authorised to agree the Terms and Conditions on behalf of all persons being booked for, including those substituted or included later, and that all these shall likewise observe the Terms and Conditions. They agree to take responsibility for the party occupying the property. In this sense, references to the Guest apply to all the occupants of the property.

 

By placing a booking, the Guest is deemed to have accepted these Terms and Conditions. Payment of the full charge also indicates acceptance of these terms and conditions.

 

 

Governing Law & Jurisdiction

The contract is deemed to have been made at Roughs Farm, Sawtry Fen, Huntingdon, Cambridgeshire, PE28 5YZ, UK. The validity, construction and performance of this Agreement shall be governed by English Law. The guests submit to the exclusive jurisdiction of the English Courts.

 

If a court finds that a condition in these terms and conditions is illegal or void, the illegal or void provision will be severed from the remainder of the terms and conditions, which will continue to be valid and have full force and effect.

 

If any litigation arises from the booking of accommodation with Us, the Courts of England shall have sole jurisdiction on such matters and English law prevalent at the time shall be applied at the time.

The disclaimer is without prejudice to your statutory and other rights as a consumer. Nothing in this agreement shall exclude or limit your or our liability for death or personal injury.

 

House Rules

  • Overnight accommodation to only be provided to guests declared on the booking form in advance of the commencement of the Rental Period
  • That the numbers of guests staying is not over the maximum for the homes which are for The Whole Home – 14, The Old Farmhouse – 10 and The Maid’s Cottage – 4, excluding infants sleeping in their own cots.
  • To take good care of the property and leave it in a clean and tidy condition at the end of the guests stay.
  • To permit the owners access to maintain the hot tubs twice daily.
  • Not to cause annoyance or become a nuisance to neighbours and occupant of adjoining properties.
  • Not to cause excessive noise between 10pm and 7.30am, especially outdoors.
  • Not to some in the properties
  • Not to bring any pets to the property other than at the prior agreement of the hosts
  • To read any fire and safety notices and advice upon arrival in the property, ask for clarification as required, paying special notice of the hot tub rules.
  • Not to re-let or sublet the property to any other guests’ group or party.
  • To only use the property strictly for residential purposes.
  • Not to use the properties for parties or gatherings of maximum allowed for each home, if this is not respected Guests could be liable for a fine up to £2000.
  • Not to use the phone line connected to the property.
  • Not to light fires or candles in the properties (except the wood burner in The Old Farmhouse)
  • Not to tamper with fire fighting equipment or fire aid kits other than in an emergency
  • On departure guests strip all beds and empty bins
  • Observe No Entry signs around the farmyard and keep children and dogs under close control when outside the property.
  • Vehicle to be parked in designated parking areas
  • No fireworks or sky lanterns to be let off at the properties.

 

To follow Hot Tub Rules including:

 

  • No unaccompanied bathing for under 18s
  • No under 16’s using the hot tub, supervise children around the hot tub at all times and ensure the cover is in on when not in use.
  • Full rules available on request and at the homes.

 

In the event of breach of terms and conditions, the Guests will be required to leave the property immediately and no refunds will be offered.

Pet Rules

  • Well behaved dogs are welcomes at both of our properties if you agree to the following rules, any breaches which lead to damage or increased cleaning will be deducted from your security deposit.
  • Dogs under one year should be discussed and allowed to stay with the agreement of the owners
  • Dogs are kept downstairs and are not allowed on the furniture
  • They are only left alone for short periods of time
  • The are treated regularly for fleas, worms and ticks
  • Dog waste is picked up and disposed of in the outside bins
  • Dogs are washed on in the Dog Wash
  • They are kept under close control on the driveway

Please let us know if your dogs are reactive as we do have dogs on the farm.

This Agreement shall begin on the date hereof.

Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. Roughs Farm Retreats does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of Roughs Farm Retreats, its agents and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions.
